Welcome to MyITDojo. These Terms of Service ("Terms") govern your access to and use of MyITDojo's web application, services, and related offerings (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
The Service provides IT knowledge management, AI-powered assistance, and collaboration tools for IT professionals and organizations.
1.1 Account Creation
To access certain features of the Service, you must create an account by providing accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.2 Eligibility Requirements
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
1.3 Account Security
You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
2.1 Subscription Tiers
MyITDojo offers multiple subscription tiers with varying features and limitations. The Explorer tier is provided free of charge with usage limits. Professional and Enterprise tiers are paid subscriptions billed monthly or annually as selected during signup.
2.2 Payment Processing
All payments are processed through Stripe, our third-party payment processor. By providing payment information, you authorize us to charge the applicable subscription fees to your chosen payment method on a recurring basis.
2.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, and you will retain access to paid features until that time. We do not provide refunds for partial billing periods, except as required by applicable law.
2.4 Price Changes
We reserve the right to modify subscription pricing with at least 30 days' advance notice to existing subscribers. Price changes will not affect your current billing cycle.
3.1 Third-Party API Integration
MyITDojo operates on a "Bring Your Own API" model for AI-powered features. You may provide your own API keys from providers such as OpenAI or Anthropic to access AI Assistant functionality. We do not provide, manage, or pay for your API usage with these providers.
3.2 API Key Security and Responsibility
You are solely responsible for obtaining, securing, and managing your API keys. We encrypt and store your API keys securely using industry-standard encryption, but you are responsible for all charges incurred through your API key's usage. You represent and warrant that you have the legal right to use the API keys you provide and that your use complies with the applicable provider's terms of service.
3.3 API Provider Terms
Your use of third-party AI services is subject to the respective provider's terms of service and privacy policies. MyITDojo is not responsible for any charges, service interruptions, or violations of API provider terms.
4.1 Your Content
You retain all ownership rights to the content you create, upload, or store through the Service ("User Content"), including knowledge base articles, journal entries, system documentation, and software catalogs. By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, and display your content solely for the purpose of providing the Service to you.
4.2 Content Responsibility
You represent and warrant that you own or have the necessary rights to all User Content you submit and that such content does not violate any third-party rights or applicable laws. You are solely responsible for your User Content and the consequences of posting or publishing it.
4.3 Content Removal
We reserve the right to remove User Content that violates these Terms or applicable laws without prior notice.
You agree not to use the Service for any illegal purpose or in violation of these Terms. Prohibited activities include but are not limited to:
- Attempting unauthorized access to the Service or related systems
- Service abuse, including excessive API requests or automated scraping
- Intellectual property infringement
- Sending spam or unsolicited communications
- Transmitting viruses, malware, or other malicious code
- Impersonating any person or entity
- Interfering with or disrupting the Service
- Collecting or harvesting personally identifiable information without consent
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
We implement industry-standard security measures to protect your information, including encryption (TLS/SSL), access controls, and secure authentication. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining your own backups of critical data. While we perform regular backups of our systems, we recommend that you regularly export your important content using our export features. We are not liable for any loss or corruption of data.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100, WHICHEVER IS GREATER.
We do not warrant or guarantee the accuracy, completeness, or reliability of any content obtained through the Service, including AI-generated responses. You are responsible for evaluating the accuracy and usefulness of all information provided by the Service.
You agree to indemnify, defend, and hold harmless MyITDojo, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any claim that your User Content caused damage to a third party.
You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination, you may export your User Content using our export features for a period of 30 days. After this grace period, we reserve the right to delete your account and all associated data.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
You agree to waive any right to a jury trial and to participate in class actions or class arbitrations. Any arbitration shall be conducted on an individual basis and not as a class action.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through prominent notices on our platform. Your continued use of MyITDojo after such modifications constitutes your acceptance of the updated Terms.
